1. تعريف الخدمة ونطاقها
BaityGo منصة عقارية رقمية تعمل عبر الموقع baitygo.com وتطبيق Android ذي الحزمة com.baitygo.online. تتيح للبالغين البحث عن العقارات ونشرها والتواصل بشأنها. لا تُعد BaityGo طرفاً في عقد بيع أو إيجار ولا وسيطاً مالياً أو قانونياً ما لم يُعلن صراحة خلاف ذلك.
2. الجهة المسؤولة
مالك ومشغّل الخدمة هو احمد جاسم العبد الخضر الصغير، ويُشار إليه باسم «المشغّل». تُرسل الاستفسارات والشكاوى وطلبات الخصوصية وإلغاء الحساب إلى contact@baitygo.com.
3. الفئات المستهدفة والأهلية
الخدمة مخصّصة حصراً لمن أتموا 18 عاماً، بمن فيهم الباحثون عن عقار والمالكون والوكلاء. بإنشاء حساب يؤكد المستخدم أنه بالغ ويتمتع بالأهلية القانونية. يجوز تعليق أو حذف الحساب الذي يتبين أنه يعود لقاصر.
4. الحساب والتحقق
يجب تقديم بيانات صحيحة واختيار كلمة مرور قوية والحفاظ على سريتها. يخضع الحساب الجديد لموافقة الإدارة والتحقق من البريد قبل تسجيل الدخول. يثبت التحقق من البريد السيطرة على عنوان البريد ولا يثبت وحده الهوية القانونية. يجوز طلب تحقق إضافي من المالك أو الوكيل عند الحاجة. يمنع انتحال الهوية ومشاركة الحساب والتسجيل الآلي.
5. العقارات ومحتوى المستخدم
يضمن ناشر العقار صحة المعلومات والصور والسعر والموقع وبيانات التواصل وامتلاكه حق نشرها. يمنح المستخدم BaityGo ترخيصاً غير حصري ومجانياً ومحدوداً بالمدة اللازمة لاستضافة المحتوى وعرضه وترجمته تقنياً وتوزيعه داخل الخدمة. يظل المستخدم مالكاً لمحتواه ومسؤولاً عنه.
6. دور المنصة والتعاملات
توفر BaityGo أدوات نشر وبحث وتواصل، ولا تضمن هوية كل معلن أو دقة كل عرض أو توفر العقار أو ملاءمته القانونية. يجب التحقق المستقل من الهوية والملكية والتفويض والأسعار والعقود قبل الدفع أو إتمام أي معاملة.
7. الاستخدامات المحظورة
يحظر الاحتيال والتضليل والعقارات الوهمية والمحتوى غير القانوني أو المنتهك للحقوق، وجمع بيانات الآخرين دون إذن، والرسائل المزعجة، ومحاولة الاختراق أو تجاوز وسائل الحماية، والتسجيلات الآلية، وتخمين كلمات المرور، وتعطيل الموقع أو التطبيق.
8. حقوق المستخدم ومسؤولياته
يحق للمستخدم الوصول وفق هذه الشروط وتصحيح بياناته والإبلاغ عن المخالفات وطلب نسخة من بياناته أو حذفها. ويلتزم بحسن النية واحترام حقوق الآخرين وتحديث معلوماته وحماية بيانات الدخول والتعاون مع التحقق الأمني المشروع.
9. حقوق المشغّل وواجباته
يبذل المشغّل عناية معقولة لتشغيل الخدمة وحماية البيانات ومعالجة البلاغات وتطبيق سياسات الأمن والخصوصية. وله مراجعة الإعلانات والحسابات، وطلب تحقق إضافي، وإزالة المحتوى المخالف، وتقييد الميزات، وتعديل أو إيقاف جزء من الخدمة لأسباب أمنية أو تشغيلية مع إشعار مناسب متى أمكن.
10. الإجراءات عند المخالفة
بحسب الخطورة، يجوز توجيه تنبيه، أو إخفاء أو حذف إعلان، أو تعليق أو إنهاء الحساب، أو حظر النشاط الآلي، أو حفظ الأدلة اللازمة، أو إبلاغ الجهة المختصة إذا تطلب القانون ذلك. يمكن الاعتراض عبر contact@baitygo.com.
11. إلغاء الحساب
يرسل المستخدم طلب الإلغاء من بريده المسجل إلى contact@baitygo.com مع اسم المستخدم. بعد التحقق، يستكمل الإلغاء خلال 30 يوماً. يُحذف أو يُخفى المحتوى المرتبط، مع الاحتفاظ فقط بما يلزم للأمن أو إثبات الموافقة أو الوفاء بالتزام قانوني وفق سياسة الخصوصية.
12. الملكية الفكرية والتوفر
تبقى حقوق اسم BaityGo وشعاره وتصميماته وبرمجياته ومحتواه الأصلي لأصحابها. تُقدّم الخدمة بحسب التوفر، ولا يضمن المشغّل خلوها من الانقطاع أو الأخطاء أو نتيجة أي معاملة. لا يستبعد ذلك مسؤولية لا يجوز استبعادها قانوناً.
13. تعديل الشروط والقبول أو الرفض
لكل نسخة رقم وتاريخ سريان. عند تعديل جوهري، يظهر ملخص واضح والنص المحدث في الموقع والتطبيق، ويختار المستخدم القبول أو الرفض صراحة. يُسجل القرار مع النسخة والوقت والقناة واللغة. عند الرفض يتوقف الاستخدام العادي، مع إبقاء وسيلة طلب البيانات أو إلغاء الحساب.
1. Service definition and scope
BaityGo is a digital real-estate platform available through baitygo.com and the Android application com.baitygo.online. It enables adults to search for and publish properties and communicate about them. BaityGo is not a party to a sale or rental contract and is not a financial or legal intermediary unless a specific service expressly says otherwise.
2. Responsible party
The service is owned and operated by احمد جاسم العبد الخضر الصغير (the “Operator”). Questions, complaints, privacy requests and account-cancellation requests may be sent to contact@baitygo.com.
3. Target users and eligibility
The service is strictly limited to people aged 18 or older, including property seekers, owners and agents. By creating an account, the user confirms legal capacity and adult status. An account identified as belonging to a minor may be suspended and deleted.
4. Accounts and verification
Users must provide accurate information, choose a strong password and keep it confidential. New accounts require administrator approval and email verification before sign-in. Email verification proves control of the address, not legal identity by itself. Owners or agents may be asked for additional verification where needed. Impersonation, account sharing and automated registration are prohibited.
5. Listings and user content
A publisher confirms that property information, media, price, location and contact details are accurate and that the publisher is entitled to provide them. The user grants BaityGo a non-exclusive, royalty-free licence limited to hosting, displaying, technically translating and distributing that content within the service. The user retains ownership and responsibility.
6. Platform role and transactions
BaityGo provides publishing, search and communication tools. It does not guarantee every advertiser’s identity, listing accuracy, property availability or legal suitability. Parties must independently verify identity, ownership, authority, price and contracts before paying or completing a transaction.
7. Prohibited conduct
Users may not commit fraud, publish misleading or unlawful listings, infringe rights, collect others’ data without authority, send spam, attack or probe the service, bypass safeguards, perform automated registrations, guess passwords, or interfere with website or app availability.
8. User rights and responsibilities
Users may access the service under these terms, correct their data, report violations and request access, export or deletion. Users must act in good faith, respect others, maintain accurate information, protect credentials and cooperate with reasonable security verification.
9. Operator rights and duties
The Operator will use reasonable care to operate the service, protect data, address reports and apply security and privacy controls. The Operator may review listings and accounts, request additional verification, remove prohibited content, restrict features, and modify or temporarily suspend parts of the service for security or operational reasons, with appropriate notice where practical.
10. Enforcement
Depending on seriousness, BaityGo may warn a user, hide or remove a listing, suspend or terminate an account, block automated activity, preserve necessary evidence, or notify a competent authority where legally required. Appeals may be sent to contact@baitygo.com.
11. Account cancellation
A user may request cancellation from the registered email address to contact@baitygo.com and include the username. After verification, cancellation is completed within 30 days. Associated content is removed or hidden, except for limited security, consent or legally required records under the Privacy Policy.
12. Intellectual property and availability
BaityGo’s name, marks, original designs, software and original content remain protected. The service is provided as available. The Operator does not guarantee uninterrupted or error-free operation or the outcome of a property transaction. Nothing excludes liability that applicable law does not permit to be excluded.
13. Changes and explicit acceptance or rejection
Each version has a number and effective date. Material changes are presented in the website and app with a clear summary. Users must expressly accept or reject the update. BaityGo records the version, decision time, channel and language. Rejection stops normal use while preserving a way to request data or account cancellation.
